SUBSCRIBER TERMS OF USE
 

Your use of Iconoculture Online is subject to a license agreement. The license agreement includes a number of provisions not fully described in these terms of use. A breach of the license agreement or these terms of use could result in a termination of the license agreement. If you would like a copy of the license agreement, please contact your employer.

Subject to the terms of the license agreement, Iconoculture grants to you a limited, nonexclusive, nontransferable, nonsublicensable, (subject to termination for breach of the license agreement) license to use Iconoculture Online, solely for your internal business purposes. No installation, implementation, customization, consultation, support or similar services are included within this scope of these terms of use. Any such services that Iconoculture may provide to you are set forth in the license agreement. RIGHTS NOT EXPRESSLY GRANTED HEREIN ARE RESERVED BY ICONOCULTURE.

ACCESS CONTROLS: The license agreement limits the number of users who are allowed access to Iconoculture’s IconoIQ. You are required to take reasonable measures to protect access information and to assure that you do not permit unauthorized use of or access to Iconoculture Online. Iconoculture may audit your use of IconoIQ to assure compliance with access restrictions and will pursue all available remedies for a breach of these access rules.

COPYRIGHT NOTICE/RESTRICTIONS ON USE OF CONTENT: The content, including the written materials, audio, video and all visuals on the Iconoculture site is the intellectual property of Iconoculture or republished by Iconoculture under limited exceptions to the copyright laws. All rights of Iconoculture or other copyright holders are reserved. Iconoculture respects the copyright rights of others and we ask you to do the same. You may only download and use content from this site as permitted by this notice. This Site contains many of the valuable trademarks, names, titles, logos, images, designs, copyrights and other proprietary materials owned and registered by Iconoculture, including all terms designated on this Site as "Macrotrends" (the "Trademarks"). Nothing contained on the Site should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Trademark displayed on the Site, or any license or right to use any other trademark owned by any other third party.

Content from the Iconoculture site may only be used, copied, and reproduced for purposes of rumination or decision support and not for commercialization of any product, service or entity, or for any other commercial purpose or to any general public audience. You agree that if you download any content that you will assure that the content is used only as permitted by this policy. If you use any content from the Iconoculture site you must agree to keep intact all copyright trademark or other proprietary or attribution notices. You also agree that you will not change any content or create your own derivative work from any content. Your use of any written content should be attributed to Iconoculture or the author if specified.

If you use content from the Iconoculture site in violation of these policies you may be in violation of the license agreement and may be subject to termination of the license agreement and damages for copyright violation under federal statutes. If you have questions regarding appropriate use of content, please contact your employer.

USE OF WEB LOG. Use of the Iconoculture web log (the “Web Log”) is subject to these additional Terms of Use. Iconoculture grants a limited, personal, non-exclusive, non-transferable license to use the Web Log for users personal use and not for resale or further distribution. Except for pre-existing rights and this License, Iconoculture retains all right, title and interest in and to the Web Log, including all related intellectual property rights. The Web Log allows users and other third parties to post comments concerning, among other things, Iconoculture and its Consumer Research and Advisory Services. All reviews and comments posted to the Web Log must be topical to the Subject Matter. Iconoculture may review and delete any content, in whole or in part, that in the sole judgment of Iconoculture violate these terms of use or which might be offensive, illegal, or that might violate the rights of or harm any third parties. Company agrees that Iconoculture is free to use any comments, information, ideas, concepts, reviews, techniques or any other material contained in any communication sent to Iconoculture, including without limitation, responses to questionnaires or through postings to the Web Log without further compensation, acknowledgement or payment to user or Company for any purpose whatsoever including, but not limited to, modifying or improving the Web Log and Iconoculture Products and Services. Furthermore, by posting any submission on the Web Log, submitting information to Iconoculture, or in responding to questionnaires, Company and user grant Iconoculture a perpetual, non-exclusive, fully paid, royalty-free, irrevocable, sublicenseable, worldwide license and right to display, use, perform, reproduce, modify, distribute and create derivative works of the submission or information submitted in any media, software or technology of any kind now existing or developed in the future. By posting or providing a submission or information, you represent and warrant that public posting and use of the submission or information by Iconoculture will not infringe on or violate the rights of any third party. IF COMPANY AND USER DO NOT AGREE TO THESE TERMS OF USE, DO NOT USE THE WEB LOG.

CONTENT OF OTHER SITES: While you are browsing the Iconoculture site you could be directed to other sites that are not owned or controlled by Iconoculture. These other sites may send to users their own cookies, collect data, solicit personal information, or contain information that you may find inappropriate or offensive. We make no representations concerning the content of sites listed on our site or their privacy policies. We cannot be held responsible for the accuracy, relevancy, copyright compliance, legality, or decency of material contained in sites listed in our site. While Iconoculture strives to protect your personal information and privacy, we cannot guarantee the security of any information you disclose online at other sites and you make such disclosures at your own risk.

DISCLAIMER AND LIMITATION OF LIABILITY: Iconoculture attempts to assure the accuracy and timeliness of all information provided on its site. However, the nature of the information reported is subject to change and different interpretations. The information in the Iconoculture site is provided "as is" and without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not make any representations or warranties as to the security of any information (including, without limitation, credit card and other personal information) you might be requested to give any third party. If the applicable law does not allow the limitation or exclusion of liability or incidental or consequential damages, our total liability to you for all damages, losses, and causes of action (whether in contract, tort, including, but not limited to, negligence, or otherwise) may not exceed the amount paid by the party under the license agreement, if any, for accessing the Iconoculture site.

These terms of use shall be construed according to the laws of the state of Minnesota. You agree that any dispute related to these terms of use must be venued in any court of competent jurisdiction in Hennepin County, Minnesota.
